诈骗罪和盗窃罪的区分属于司法实践中的难题。可以从具体案件出发对它们二者进行界分。具体来说,对诈骗罪和盗窃罪予以甄别应该从具体实施的犯罪方法、是否令人产生错误认识和是否他人拥有相应处分权或地位而基于错误处分公、私财物三方面进行。
