从业禁止是我国刑法典中新规定的一种非刑罚处罚措施。它的司法适用存在不少困惑,因此从利用职务便利、违背职业要求特定义务、适用阶段和具体实施要求三方面出发对其具体适用进行分析具有现实意义。在利用职务便利上,它必须是工作内所具备的主管、管理、经手本单位财物的权利;在违背职业要求特定义务上,它可以带有平等性且必须做狭义界定;在适用阶段和具体实施要求上,它不包括死刑和无期徒刑、终身监禁,且必须确保禁止的是与其利用职务便利或违背职业要求特定义务最密切联系的相关职业。

The occupation prohibition is an new non-criminal punishment measure in criminal law code of our country. It＇ s judicial application exists a lot of puzzles. By analyzing its concrete application at three aspects： using the post convenient, violating the special responsibility of professional demand, apply stage and concrete apply demands.
